Employee or self employed? Check the AHV criteria

Is the person who works in your home your employee?
In most cases, yes. The AHV leaflet on household work says that in a private household, in principle every paid activity is subject to AHV contributions. The AHV leaflet for the self employed says that the compensation office decides who is self employed, case by case and for each activity, on the economic facts and not on the contract. Until it has decided that in writing, the safe course is to treat the work as employment and register as the employer.

What does not settle it on its own
The office looks at the facts as a whole. None of these points settles the question on its own:
- what the contract calls the arrangement (WML, margin no. 1030)
- whether it is a main job or a side job (WML, margin no. 1033)
- that the person works for several households (WML, margin no. 1035)
- that the person is already registered as self employed for other work (WML, margin no. 1034)
- an entry in the commercial register (selbststaendig-erwerbend.ch, frequently asked questions)
- how the tax office treats the income (WML, margin no. 1038)
